General Contractual Provisions

The masculine form applies representatively for the feminine spelling.

 

1) SCOPE OF APPLICATION

 The operator of the online shop www.cachet.ch and your contractual partner is:

By placing an order on cachet.ch, you accept the General Terms and Conditions (GTC) between you and Populart AG (hereinafter referred to as cachet.ch or we/us). These General Terms and Conditions apply only to the purchase of products via the online shop, but not to the purchase of products in our Cachet stores.

Orders in our online shop are exclusively accepted on cachet.ch. Orders via phone, letter, fax or e-mail are excluded and will not be processed.

 

2) DELIVERY

We deliver throughout Switzerland and we deliver the goods directly to the specified delivery address. The delivery time is normally 5-7 working days, but delivery delays are reserved in exceptional cases. For the delivery of large furniture and bulky items, we will arrange a delivery date, whereby the delivery period may be longer than 7 working days. Claims for damages due to delayed or non-delivery are excluded, and any payments already made will be refunded. For security reasons, when paying by invoice, the invoice address cannot differ from the delivery address. If the package is already damaged upon delivery, please complain to the courier immediately or inform us.

 

3) SHIPPING COSTS

  1. In principle, we charge shipping costs of CHF 7.--
  2. From CHF 80.-- onwards, deliveries are free of shipping costs (excluding furniture)
  3. For furniture:
    • Curbside delivery: free
    • 2-person delivery to apartment: CHF 150.--

  

4) STOCK

It is possible that the goods are no longer available when an order is received. The item in the order will be cancelled accordingly and you will be informed promptly by e-mail. Claims for damages due to delayed or non-delivery are excluded. Payments already made will be refunded.

 

5) PAYMENT METHODS

The following payment methods are available for your purchase:

  • Payment by credit card
  • Payment with Twint
  • Payment in advance
  • Purchase on account with partial payment option (POWERPAY)
MF Group / POWERPAY offers the "purchase on account" payment method as an external payment service provider. With the single invoice, you can easily pay for your online purchase by invoice. If you choose not to pay within the specified timeframe, you will subsequently receive a monthly invoice in the following month with an overview of your orders.



Upon conclusion of the purchase agreement, POWERPAY assumes the outstanding invoice claim and handles the corresponding payment modalities. When purchasing on account, you also accept, in addition to our GTC, the POWERPAY GTC. 



The purchase on account option is only available to private customers.


 

 

 

6) DISCOUNTS/VOUCHERS

Discounts/vouchers cannot be combined with other discounts/vouchers and refer only to cachet.ch. Vouchers without a promo code cannot be redeemed.

 

7) VALUE ADDED TAX

All prices include VAT. Price changes and erroneous price information are reserved.

 

8) WARRANTY

Within 14 days of receipt of the goods, please report material or manufacturing defects in writing or by e-mail (onlineshop@cachet.ch) to our customer service. Defective items must be noted on the delivery note when returned. We assume no liability for material or manufacturing defects reported later.

 

9) RETURN POLICY

Ordered items can be returned within 14 days of receipt in their original packaging. Returns of reduced items are excluded. Only undamaged, unworn and undamaged items with the corresponding delivery note will be accepted for return. Should we discover a deterioration of the goods, we are entitled to retain a portion of the purchase price paid, which we determine at our discretion. The return is at your expense and the date of the postmark is binding for returns.

10) IMAGE AND TEXT RIGHTS

All image and text rights used on the online shop's website belong to Populart AG. Any use whatsoever without our express consent is strictly prohibited.

 

11) DATA PROTECTION

You agree that your data will be registered and processed in the cachet.ch database. At the same time, you allow us to use your data for internal marketing purposes. You are personally responsible for your login (incl. password) and the orders placed with it.

 

12)  APPLICABLE LAW, PLACE OF JURISDICTION

These General Terms and Conditions and the use of the online shop are subject to Swiss law. The place of jurisdiction is CH-8157 Dielsdorf.
